1. Identity of the Seller

ScoutingDesk is a trade name of BLLN Sports Group Comm V, with registered office at De Tomermaat 11, 2930 Brasschaat, Belgium, VAT number BE0770498813, managed by Tom Billen.

Throughout these Terms & Conditions, “ScoutingDesk”, “we”, “us” and “our” refer to BLLN Sports Group Comm V.

2. Scope

These Terms & Conditions govern all purchases, downloads, licenses and use of ScoutingDesk software, downloadable files, templates, related digital materials and any associated services made available through the ScoutingDesk website.

3. Nature of the Product

ScoutingDesk is sold as downloadable standalone software and related digital materials.

ScoutingDesk is not sold as a subscription service, cloud platform, hosted SaaS environment or ongoing online service, unless explicitly stated otherwise.

After purchase, the customer receives access to the purchased software and/or related digital files through their account and/or by email.

4. Account Requirement

To purchase and download ScoutingDesk products, the customer may be required to create an account or log in.

The account is used solely for purposes such as:

  • purchase processing
  • download access
  • license delivery
  • account management
  • support and communication related to the order

The customer is responsible for maintaining the confidentiality of account credentials and for all activity carried out through the account.

5. Packages

ScoutingDesk may offer different packages, including but not limited to:

  • Club Package
  • Agency Package
  • Player Package

Each package includes only the features, report types and materials described on the website at the time of purchase.

6. Orders and Payment

An order is complete only once payment has been successfully received and confirmed.

ScoutingDesk reserves the right to refuse, suspend or cancel any order in case of suspected fraud, misuse, pricing errors, payment issues or other legitimate business reasons.

7. Delivery

After successful payment, the customer will receive access to the purchased product, including where applicable:

  • a download link
  • a license key
  • installation instructions
  • order confirmation

Delivery is deemed completed once the digital product or download access has been made available to the customer through the account and/or by email.

8. License Grant

Subject to full payment and compliance with these Terms, ScoutingDesk grants the customer a limited, non-exclusive, non-transferable, non-sublicensable license to use the purchased software and materials for their own internal use only.

Unless expressly authorized in writing, the customer may not:

  • resell, rent, sublicense or redistribute the software
  • share login credentials, download files or license keys outside the purchasing person or organization
  • reproduce the software for commercial redistribution
  • modify, reverse engineer, decompile or attempt to derive source code, except where mandatory law expressly allows this

9. Permitted Use by Customer Type

If the customer purchases a Club Package, use is limited to the internal organization of that club.

If the customer purchases an Agency Package, use is limited to the internal organization of that agency.

If the customer purchases a Player Package, use is limited to that individual player.

Any use outside the purchasing person or organization is prohibited unless expressly approved in writing.

10. Anti-Sharing / Misuse

The customer agrees not to share, copy, distribute or make available the software, templates, generated materials, account access or license credentials outside the authorized purchasing person or organization.

ScoutingDesk may use technical and contractual measures to reduce abuse, including:

  • license identifiers
  • watermarks
  • traceable license references
  • limited activation rules

In the event of unauthorized sharing, redistribution or misuse, ScoutingDesk reserves the right to suspend access, deactivate a license and pursue any legal remedies available under applicable law.

11. Consumer Withdrawal / Refund Policy

11.1 Business Customers

For business customers, all sales are final except where mandatory law provides otherwise.

11.2 Consumers

If the customer is a consumer, the statutory right of withdrawal may apply unless it is lawfully excluded for downloadable digital content.

By completing the purchase and requesting immediate delivery or download of the software, the consumer expressly agrees to immediate performance and acknowledges that, once delivery begins, the statutory right of withdrawal is lost to the extent permitted by applicable law.

11.3 Defective or Non-Conforming Software

Nothing in these Terms excludes mandatory statutory rights relating to defective, non-conforming or unlawfully supplied digital content or software.

12. Support, Updates and Availability

Unless expressly included in the purchased offer, ScoutingDesk is under no obligation to provide ongoing maintenance, feature updates, upgrades or support beyond what is described at the time of purchase.

ScoutingDesk may provide bug fixes, improvements or updates at its own discretion.

13. Customer Responsibilities

The customer is responsible for:
  • ensuring device compatibility
  • entering accurate information into the software
  • securely storing downloaded files and license credentials
  • using the software lawfully and professionally
  • keeping account details accurate and up to date

14. Intellectual Property

All intellectual property rights in and to ScoutingDesk, including the software, templates, design, branding, logo, text, structure, downloadable materials and documentation, remain the exclusive property of BLLN Sports Group Comm V and/or its licensors.

No ownership rights are transferred to the customer.

15. Acceptable Use

The customer may not use ScoutingDesk:
  • for unlawful purposes
  • to infringe the rights of third parties
  • in a misleading or deceptive manner
  • in any way that harms the software, brand or reputation of ScoutingDesk

ScoutingDesk is intended as a professional reporting tool. Final sporting, recruitment or business decisions remain entirely the responsibility of the customer.

16. Limitation of Liability

To the maximum extent permitted by law, ScoutingDesk shall not be liable for any indirect, incidental, special or consequential damages, including loss of profit, loss of business, loss of data, reputational damage or lost opportunity.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

17. Privacy

Personal data is processed in accordance with the ScoutingDesk Privacy Policy.

18. Changes to the Terms

ScoutingDesk may update these Terms & Conditions from time to time.

The version in force at the time of purchase shall apply to that purchase, unless mandatory law requires otherwise.

19. Governing Law and Jurisdiction

These Terms & Conditions are governed by Belgian law.

Any dispute shall be submitted to the competent courts of Belgium, unless mandatory consumer law provides otherwise.
